Welcome to FORMULA.

These Terms of Service explain the rules that apply when you visit our website, create an account, place an order, or purchase products from us.

Throughout these Terms, “FORMULA,” “we,” “us,” and “our” refer to ADVANCED BIOPERFORMANCE, S.L., operating under the brand name FORMULA.

By accessing our website or placing an order, you agree to these Terms of Service, our Privacy Policy, Return & Refund Policy, and Shipping Policy.

If you do not agree to these Terms, please do not use our website or purchase our products.

1. Eligibility and Account Information

You must be at least the age of majority in your state of residence and legally able to enter into a binding agreement to place an order through our website.

When creating an account or placing an order, you agree to provide information that is accurate, current, and complete.

You are responsible for keeping your account credentials secure and for activity carried out through your account. Please contact us promptly if you believe your account has been accessed without your permission.

You may not transfer, sell, assign, or share your account with another person.

2. Our Products

We do our best to describe and display our products as accurately as possible.

However, product colors and appearance may vary slightly depending on your screen settings, device, lighting, photography, and the characteristics of the materials.

Minor differences in color, texture, finish, or packaging that do not affect the product’s essential characteristics will not be considered defects.

We may update product descriptions, packaging, prices, or availability from time to time. We may also discontinue products or limit the quantities available for purchase.

FORMULA products are textile products. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Information provided on our website is for general informational and cosmetic purposes only and should not be considered medical advice.

Individual experiences and cosmetic results may vary depending on factors including skin type, product care, sleeping habits, and frequency of use.

3. Orders and Acceptance

When you place an order, you are making an offer to purchase products from FORMULA.

An order acknowledgment or order confirmation means that we have received your order. It does not necessarily mean that we have accepted it.

Your order is accepted when we send you a shipping confirmation or otherwise expressly confirm that the order has been accepted.

Before accepting an order, we may decline or cancel it when reasonably necessary, including in cases of:

• Suspected fraud or unauthorized payment

• Incorrect pricing or product information

• Product unavailability

• Shipping restrictions

• Technical or payment-processing errors

• Unusually large quantities

• Suspected unauthorized commercial resale

• Violation of these Terms

If we cancel an order after payment has been processed, we will issue a full refund to your original payment method.

Please review your shipping address and order details carefully before completing your purchase. We may not be able to change or cancel an order once it has entered processing.

Our products are intended for personal and household use. Products may not be purchased for unauthorized commercial resale without our prior written permission.

4. Prices, Taxes, and Payment

All prices are displayed in U.S. dollars unless otherwise stated.

Prices, discounts, and promotions may change without notice. The price charged will be the price displayed at checkout when your order is placed.

Applicable sales tax and shipping charges will be calculated and displayed at checkout before you complete your purchase.

You agree to provide accurate billing and payment information and confirm that you are authorized to use the payment method provided.

Occasionally, a pricing, product-description, availability, or other material error may occur.

If we discover a material error after you place an order, we may contact you to confirm the corrected information or cancel the affected order and issue a full refund.

Promotions may be subject to separate terms and conditions. Where promotional terms conflict with these Terms, the promotional terms will apply to that promotion.

Discounts cannot be combined unless we expressly state otherwise.

5. Shipping and Delivery

We currently ship only to eligible addresses within the United States.

Available shipping methods, shipping charges, and estimated delivery times will be displayed at checkout.

Delivery dates are estimates and are not guaranteed. Delivery may be affected by carrier delays, severe weather, high order volumes, address issues, service interruptions, and other events outside our reasonable control.

If we are unable to ship your order within the timeframe stated at checkout, we will contact you with an updated estimated shipping date.

Where required by applicable law, you will have the option to agree to the delay or cancel the affected order and receive a full refund.

Please make sure that your shipping address is complete and correct. FORMULA is not responsible for delays or failed deliveries caused by an incorrect or incomplete address provided by the customer.

If an order is returned to us because of an incorrect address, failed delivery attempt, refusal of delivery, or failure to collect the package, we may deduct the original shipping cost and any return shipping charges from the refund, to the extent permitted by law.

Once your order has shipped, we will provide tracking information when available.

If your package appears to be lost, damaged, or delivered incorrectly, please contact us promptly so that we can help investigate the issue with the carrier.

If carrier tracking confirms that a package was delivered to the shipping address provided with the order, a replacement or refund is not guaranteed. We will review such situations individually and assist with a carrier investigation where appropriate.

Nothing in this section limits any right that cannot legally be excluded.

6. Returns and Refunds

Returns and refunds are handled according to our Return & Refund Policy available on our website.

Eligible full-price products may be returned within 30 days of delivery, provided they meet the conditions stated in the Return & Refund Policy.

To qualify for a return, an item must generally be:

• Unused and not slept on

• Unwashed and unaltered

• Free from stains, makeup, hair, odors, and other signs of use

• Returned in its original packaging

• In a condition suitable for resale

Customers are responsible for arranging and paying for standard return shipping.

FORMULA does not provide prepaid return shipping labels for standard returns.

Original shipping charges are non-refundable unless the item is damaged, defective, incorrect, or applicable law requires otherwise.

Returns must be approved before they are sent. Products returned without prior authorization may not be accepted.

7. Sale and Final Sale Items

Products clearly marked “Sale” or “Final Sale” at the time of purchase cannot be returned, exchanged, or refunded.

A promotional or discount code applied to an otherwise full-price product does not automatically make that product final sale unless this is clearly stated before purchase.

Sale and Final Sale restrictions do not apply if the product arrives damaged, defective, or different from what was ordered.

8. Damaged, Defective, or Incorrect Products

Please inspect your order when it arrives.

If your product is damaged, defective, or different from what you ordered, contact us as soon as possible at advancedformulagroup@gmail.com.

Please include:

• Your order number

• A brief description of the issue

• Clear photographs of the product

• Photographs of the packaging, where relevant

We may request additional information reasonably necessary to evaluate the issue.

Once the issue has been reviewed, we will provide an appropriate solution, which may include a replacement, refund, partial refund, or another reasonable remedy.

Nothing in this section limits any warranty or consumer right that cannot legally be excluded.

9. Exchanges

We do not currently offer direct exchanges.

To receive a different product, you may return an eligible original purchase in accordance with our Return & Refund Policy and place a new order separately.

Sale and Final Sale products are not eligible for exchange.

10. Intellectual Property

All content made available through our website—including the FORMULA name and logo, product names, product designs, photographs, videos, graphics, text, packaging designs, slogans, and website design—is owned by or licensed to FORMULA and is protected by applicable intellectual property laws.

You may use our website only for personal, non-commercial purposes.

Without our prior written permission, you may not:

• Copy, reproduce, republish, modify, or distribute our website content

• Use our photographs, videos, branding, or product descriptions for commercial purposes

• Create products or materials using our trademarks, packaging, or designs

• Suggest that you are affiliated with or endorsed by FORMULA

• Systematically collect, scrape, extract, or download content or data from our website

• Use our content to train, develop, or improve an artificial intelligence system or commercial database

• Attempt to register or use a name, trademark, domain, or social media account confusingly similar to FORMULA

All rights not expressly granted in these Terms are reserved.

11. Reviews and Content You Submit

You may have the opportunity to submit product reviews, photographs, videos, comments, feedback, or other content.

You confirm that content you submit:

• Is truthful and reflects your genuine experience

• Belongs to you or that you have permission to share it

• Does not infringe another person’s intellectual property, privacy, publicity, or other rights

• Is not unlawful, misleading, defamatory, abusive, obscene, or harmful

• Does not contain malicious code or unauthorized advertising

• Properly discloses any compensation, free product, discount, or other incentive received in connection with the content

When you submit content for publication or tag FORMULA in content that you invite us to share, you grant FORMULA a non-exclusive, worldwide, perpetual, royalty-free, transferable, and sublicensable license to use, reproduce, edit, adapt, publish, display, distribute, and share that content in connection with our website, social media, advertising, promotional materials, and other marketing activities.

This license does not transfer ownership of your content to FORMULA.

We may decline to publish or may remove content that violates these Terms, contains personal information, is unrelated to the product, appears fraudulent, or is otherwise unlawful.

We will not remove a review solely because it expresses a negative opinion about a product.

You remain responsible for the content you submit and its accuracy.

12. Third-Party Services and Links

Our website may use or link to services provided by third parties, including Shopify, payment processors, shipping carriers, analytics providers, advertising platforms, social media platforms, and other technology providers.

We do not control third-party websites or services and are not responsible for their content, availability, security, accuracy, or privacy practices.

Your use of a third-party service may be governed by that provider’s own terms and policies. Please review those terms before using the service or providing personal information.

We are not responsible for purchases made directly from third-party websites, even where a link to the third-party website appears on our website.

13. Relationship With Shopify

FORMULA is powered by Shopify, which enables us to provide our website and online store.

However, any sale or purchase made through our store is made directly between you and FORMULA.

Shopify is not responsible for any aspect of sales between you and FORMULA, including any injury, damage, or loss resulting from products purchased from FORMULA.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions made with FORMULA.

14. Privacy

Our collection and use of personal information are described in our Privacy Policy available on our website.

Because our store is hosted by Shopify, certain information about your access to and use of the website may also be processed by Shopify.

Information may also be shared with service providers that help us operate the store, process payments, prevent fraud, fulfill orders, deliver packages, analyze website activity, communicate with customers, and provide advertising.

You may use our website only for lawful purposes.

• A purchase made through the website

The remaining provisions will continue to apply.

If we do not immediately exercise or enforce a right under these Terms, that does not mean that we have waived that right.

A waiver will be effective only if it is made in writing.

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and any applicable promotional terms, form the entire agreement between you and FORMULA regarding your use of the website and purchases from us.

If a promotion has separate written terms that conflict with these Terms, the specific promotional terms will apply to that promotion.

26. Governing Law and Jurisdiction

These Terms and any separate agreement between you and FORMULA are governed by the laws of Spain, without regard to conflict-of-law principles.

Any dispute that cannot be resolved informally will be submitted to the courts with jurisdiction over the registered office of ADVANCED BIOPERFORMANCE, S.L.

Nothing in this section limits any mandatory consumer protection right that applies in the customer’s state or place of residence, including any right to bring a claim in another jurisdiction where such a right cannot legally be waived.

27. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, products, policies, or legal obligations.

The current version will be posted on this page with the date of the latest update.

Material changes will apply from the effective date stated in the updated Terms.

Changes will not retroactively alter the terms that applied to an order already placed unless required by applicable law.

Your continued use of the website after updated Terms become effective means that you accept the revised Terms.
